User Agreement

Capital City Dispatch is a Business to Business designed to assist the manufacture and small transportation company in receiving transportation services for shipments of freight.
THE FOLLOWING DESCRIBES THE TERMS ON WHICH CAPITAL CITY DISPATCH OFFERS YOU ACCESS TO ITS SERVICES.  IF YOU ACCEPT THE TERMS AND CONDITIONS BELOW.  THIS AGREEMENT IS INTENDED TO BECOME AND BECOMES A LEGALLY ENFORCEABLE CONTRACT. YOU AGREE TO THE FOLLOWING TERMS:

Right to Amend Terms. Capital City Dispatch reserves the right to amend or modify the terms contained in this Agreement at any time by posting the amended terms on its site www.capitalcitydispatch.com/updates. The amended terms shall automatically be effective once they are posted on our Website, and shall affect all agreements entered into after that date.

Eligibility for Services. You must be an adult to use our services. If you are below the age of majority and cannot legally enter into contracts under the law of the state of Kansas, you may not use our services to contract. Our services are not available to minors. If you do not qualify, please do not use our services. Transportation Company’s must have proper operating authority from government agencies to contract on this site (We will verify). Failing to do so will make void all contracts entered into among the unauthorized party. Capital City Dispatch.com reserves the right to refuse services to anyone, at any time for any reason.

Trucking Company Fees. All prices are subject to change with a 30 day notice. Unless otherwise stated, all fees are quoted in U.S. Dollars. Transportation Company’s are responsible for paying all applicable fee’s to procure a listing from us. We may, at our sole discretion, add, delete or change some or all of our services at any time.

Shippers.  All shippers must fill out an application and contract with Capital City Dispatch.  All shipper memberships have no fees.

Release of Liability. In the event that a user has a dispute with one or more Shippers and Transportation Companies, the user releases Capital City Dispatch.com and its agents and employees from any claims, demands and damages (actual and consequential) of every kind and nature, known and unknown, suspected and unsuspected, disclosed and undisclosed, arising out of or in any way connected with such disputes.

Transportation Companies. Carrier shall be liable for all loss, damage or liability incurred by transportation of property arranged for by the shipper while being transported by the carrier unless otherwise expressively stated.

Listings. Listings of services are paid by the transportation company at a per shipment fee on Capital City Dispatch’s Website.

Improper Use of Your Account. Capital City Dispatch.com may suspend or terminate your account if you are found to have engaged in fraudulent activity in connection with our site or if user has a poor performance feedback report (determined by administrator) or for any other reason that weakens the value of the site to others. User may not corrupt or cause anything to weaken the performance of the site or system.

Right of Refusal. Capital City Dispatch.com reserves the right to refuse service to any person, at any time, and for any reason. We also reserve the right to refuse posting.

Information Provided to Capital City Dispatch.com. You are responsible for the truth and accuracy of any information you provide to us or other users during the registration, or listing process, in any public message area or through any email. Certain personal data is required from you for registration into the site, such as name, address, e-mail, etc. This personal data will be used internally by Capital City Dispatch to assist in improving the site such as content and effectiveness. Personal and business information about individuals and companies will not be provided to any third party. We keep no personal credit card information on out site!

Breach. We may immediately issue a warning, temporarily suspend, indefinitely suspend or terminate your use of our Website, including canceling any of your current posting, if you breach this Agreement, or if we are unable to verify or authenticate any information you provide to us.
No Warranty. USE OF THE CAPITAL CITY DISPATCH.COM WEBSITE AND OUR SERVICES IS WITHOUT ANY WARRANTY OR CONDITION, EXPRESS OR IMPLIED. WE AND OUR SUPPLIERS SPECIFICALLY DISCLAIM ANY IMPLIED WARRANTIES WHATSOEVER. We do not guarantee continuous, uninterrupted or secure access to our services, and operation of our site may be interfered with by numerous factors outside of our control.

Limit of Liability. IN NO EVENT SHALL WE BE LIABLE FOR LOST PROFITS OR ANY SPECIAL, INCIDENTAL OR CONSEQUENTIAL DAMAGES (HOWEVER ARISING, INCLUDING NEGLIGENCE) ARISING OUT OF OR IN CONNECTION WITH THIS AGREEMENT.

General Compliance with Laws. You shall comply with all applicable laws, statutes, ordinances and regulations regarding your use of our service, posting of listing.
Agency. You and Capital City Dispatch.com are independent contractors, and no agency, partnership, joint venture, employee-employer or franchisor-franchisee relationship is intended or created by this Agreement. Shippers are responsible for sending the necessary tax form (Tax Form 1099) to the carriers.

Arbitration. Any controversy or claim arising out of or relating to this Agreement shall be settled by binding arbitration individually.

General. This Agreement shall be governed in all respects by the laws of the State of Kansas as such laws are applied to agreements entered into and to be performed entirely within Kansas.

Registration.  If you agree with this agreement go to shipper/transportation registration and complete the registration form.  By completing the registration form is the same as signing this agreement.
